Public debate on the Draft Civil Code was held in Novi Sad

20160129_145121 Public debate on the preparation and presentation of the preliminary Draft Civil Code of the Republic of Serbia was held in Novi Sad, at the premises of the Appellate Court.The debate was organized by the Ministry of Justice of the Republic of Serbia, in cooperation with the Appellate Court in Novi Sad, with the support of GIZ.

The debate was attended by the representatives of the Commission for Civil Code Drafting, members of the expert public, judges of the Supreme Court of Cassation, judges of the Appellate Court in Novi Sad, judges from the courts in Vojvodina, court interns, representatives of the Bar Association of Vojvodina, representatives of civil society, including lawyers from the Belgrade Centre for Human Rights, as well as by other experts.

The proposed solutions from the preliminary Draft in relation to the contract law, the family law and the inheritance law were reviewed on this occasion. The discussion focused mostly on new institutes, such as euthanasia, surrogate motherhood, same-sex union (on this issue, the special debate was announced to be held), but also on recovering of the institute of the partial adoption, as well as the religious forms of marriage, which would be equal to the civil one. The focus was also on regulating the endowments, on the personal rights, on particular provisions regulating compensation, as well as on a number of solutions from the General Part of the preliminary Draft.

Representatives of the Commission for drafting the Civil Code noted the comments and suggestions and said that “for many solutions it remains to be subsequently decided whether and in what way they would be incorporated into the final version.” It was announced that the public debates will also be held in Kragujevac and in Nis.

The Commission representatives have invited the general, professional and general public, to present their view of the preliminary Draft through comments and suggestions.
